Warranty Information

Unless otherwise stated, new night vision devices sold by DARQ Industries LLC (hereby referred to as either DARQ Industries LLC or DARQ Industries) carry a transferable (authorization required) ten year warranty on night vision monoculars and a five year transferable warranty on night vision dual tube devices.

This warranty covers the housing and image intensifier of the device against manufacturer and workmanship defects. This warranty does not cover normal wear and tear, damage, debris, damage or debris from modified or disassembled devices, devices with serial number or any part thereof altered, defaced, destroyed, or removed, or any condition or happenstance induced by an external variable. It is up to the sole discretion of DARQ Industries to determine and allow or deny any warranty concern or claim. In the event a concern is covered, we will either repair or replace the product or component with an equivalent, provided an equivalent replacement is attainable. If an equivalent replacement is not attainable we will make a substitution at our discretion and selection. We may also offer alternative options of equal, lesser, or greater value. If a lesser value option is selected we will offer a refund amount determined to be suitable to the cost difference at our discretion. If a greater value option is selected we will generate an invoice for the greater value amount. This shall be the full extent of coverage, no compensation may be sought in place. There may be varying timeframes in repairing or replacing a product or component. A timeframe estimate will be provided if your warranty claim is authorized. Bear in mind, this is an estimate and may vary in being either shorter than the projected timeframe or longer depending on various factors. Devices bearing our previous name are covered within the same scope of this policy.

This warranty does not apply or cover devices, parts, components, labor, shipping, or any effect of these if any of the following are determined:

  • Misuse, negligence, abuse
  • Products used in an inappropriate manner
  • Products altered, modified, or repaired by anyone other than DARQ Industries without prior written consent of DARQ Industries
  • Products altered, modified, or repaired by anyone other than DARQ Industries found to be damaged
  • Labor resulting from alterations, modifications, or repair attempts from anyone other than DARQ Industries
  • Light exposure, laser exposure, over exposure, light damage
  • Impact damage
  • Use of improper battery, or rechargeable with improper voltage, or otherwise not acceptable
  • Other external variables or happenstances not described
  • Discontinuance by the manufacturer
  • Products specifically requested and special ordered for a customer which are not regular inventory
  • Products provided by the customer which are not purchased from DARQ Industries
  • Quality, condition, function, and other effects of products provided by the customer which are not purchased from DARQ Industries

No other warranties will be applied other than this warranty.

Warranty claims falling outside of the scope of these written warranty terms may incur repair, parts, labor, and shipping fees charged to the customer

Pre-owned, trade-in, limited run, and other products may be subject to their stated warranty terms as noted in their descriptions and are not subject to the 10 and 5 year warranties. If no warranty is stated for a pre-owned, trade-in, limited run, or other non standard device then no warranty applies.

Warranty Request

To request a warranty claim please email info@DARQIndustries.com with the following information:

  • Reason for request with description of condition and concern
  • Order number
  • Date of purchase
  • Device Serial Number
  • Image intensifier serial number(s)

The user is responsible for sending their product to DARQ Industries and assumes all liabilities in product safety and transit. The customer is responsible for return shipping charges unless otherwise stated.

Warranty Transfer

The purpose of the warranty inspection is to verify the device condition and function for the new owner to validate nothing has been altered or damaged. This provides both the buyer and seller with comfort in knowing the device is in proper functional condition as a means of additional buyer and consumer protection.

To transfer the remaining warranty an inspection must be performed prior to transfer of ownership. There is no cost for a warranty transfer inspection. The warranty transfer process is outlined below. This policy was adopted on 07/01/2023. Devices sold prior to 07/01/2023 are not eligible for warranty transfer. 

1. Contact Us: Provide your order number, device serial number, intensifier serial number (located on the data sheet), purchaser name of who is buying the device. 

2. Inspection Coordination: Once authorized, arrange to send the device in for inspection with us. The user/customer is responsible for all shipment, transit charges, and liabilities. Packages sent to DARQ Industries without prior authorization will be refused.

3. Return Shipping: The user/customer may supply a return shipping label for DARQ Industries to use when sending the device back after inspection. Alternatively, return shipping can be purchased from DARQ Industries. If the customer chooses to provide a shipping label but fails to do so, return shipping must be purchased.

4. Inspection Completion: Once the inspection is completed, the device will be returned to the original owner (not the new owner), using either the provided label or the purchased shipping method.


Finished Goods, Accessories, and Other Products

DARQ Industries also sells products and accessories manufactured or produced by other companies. These items will maintain a warranty through the manufacturer. To obtain warranty support for these products please contact the product manufacturer.

General Statement

Night vision can be damaged from light exposure, lasers, and daytime use; regardless of pinhole cap (day cap, day filter) use. We do not advise storing your night vision with batteries installed. This will prevent accidental battery corrosion, accidental light exposure, or leaving your device on by mistake. It is the user’s responsibility to understand the capabilities and limitations of night vision to avoid damage. If you have any questions, please contact us. The majority of damage is due to simple mistakes. If you happen to damage a device, housing, or lens assembly we are able to remedy the condition via servicing or replacement. Cost for repair or replacement will be determined after a diagnostic is performed.

DARQ Industries shall not be responsible for any defects or damage that in DARQ Industries' view or interpretation are a result from the mishandling, abuse, misuse, improper storage or improper operation of the device, including use in conjunction with equipment that is electrically or mechanically incompatible with, or of inferior quality to, the product, as well as failure to maintain the environmental conditions specified by the manufacturer. THE CUSTOMER IS HEREBY NOTIFIED THAT OPERATION OF THE EQUIPMENT DURING DAYLIGHT HOURS OR UNDER ANY EXCESSIVE LIGHT CONDITIONS MAY PERMANENTLY DAMAGE THE INTERNAL COMPONENTS OF THE UNIT, AND SAID DAMAGE WILL NOT BE COVERED UNDER THIS WARRANTY. This warranty is extended only to the original purchaser. Any breach of this warranty shall be enforced unless the Customer notifies DARQ Industries LLC via email within the applicable warranty period. Upon which DARQ Industries LLC will request original order number, device data sheet, device serial number, or other information DARQ Industries LLC deems necessary.

 LIMITATION OF LIABILITY

DARQ Industries LLC will not be liable for any claims, actions, suits, proceedings, costs, expenses, damages or liabilities arising out of the use of any DARQ Industries LLC product or service. Operation and use of products are the sole responsibility of the Customer. DARQ Industries LLC exclusive undertaking is limited to providing the products and services outlined herein in accordance with the terms and conditions of this Agreement. The stipulation of products sold and services performed or rendered by DARQ Industries LLC to the Customer shall not be interpreted, construed, or regarded, either expressly or implied, as being for the benefit of or creating any obligation toward any third party of legal entity outside of DARQ Industries LLC and the Customer; DARQ Industries LLC obligations under this Agreement extend solely to the Customer. DARQ Industries LLC liability hereunder for damages, regardless of the form or action, shall not exceed the fees or other charges paid to DARQ Industries LLC by the customer or customer’s dealer. DARQ Industries LLC shall not, in any event, be liable for special, indirect, incidental, or consequential damages, including, but not limited to, lost income, lost revenue, or lost profit, whether such damages were foreseeable or not at the time of purchase, and whether or not such damages arise out of a breach of warranty, a breach of agreement, negligence, strict liability or any other theory of liability, in the scope of DARQ Industries LLC interpretation and view.

PURCHASER AGREEMENT

You agree to indemnify, defend, and hold harmless DARQ Industries LLC, its owners, members, licensors, and suppliers from and against all loses, expenses, damages, and costs. Including reasonable attorneys' fees, resulting from your purchase.
